My parked car was hit head on by a drunk driver, and now I want it totaled out, but at-fault insurance won't?
My Jetta was legally parked on the street, and the drunk driver hit it head on while driving the wrong way while on my one-way street. He hit my car with so much force, he pushed it 4ft back onto the curb and subsequently flipped his car in the air, and it landed upside down on its roof. Fortunately and unfortunately, the cosmetic damage is minimal, but there are major internal and mechanical issues caused by the accident: car won't start, the actual engine is not sitting correctly under the hood and is making a clicking noise, the axle is bent, the front driver's side tire was literally snapped off the axle, and the trunk was forced open and now won't close. The insurance company won't total out my car because the appraiser said it looks fine cosmetically. I want it totaled out-- I don't want to have a car with major mechanical issues, in case of future problems ociated with the accident (including loss of resell value, loss of warranty, etc). What can I do? What are some options?
